New Construction

Construction of a new home has the potential exposure to unique title pitfalls that may impact the lender and owner. You may think you are the first property owner when you are constructing or buying a newly built home. However, there were most likely many prior owners of the unimproved land. A title search will uncover any existing liens and a survey will determine the boundaries of the property you are purchasing.

Since your lender wants to be sure the property has clear title, they will require that a Loan Policy of Title Insurance be purchased. But a Loan Policy only protects the lender. By purchasing an Owner’s Policy of Title Insurance, you will be protected from covered threats to your title and ownership that went undiscovered at the time of closing.

1031 Exchanges

If you are selling your property and are concerned about having to pay capital gains taxes on the proceeds, you may want to consider a 1031 Exchange.

A 1031 Tax Deferred Exchange is one of the few tax shelters remaining. Its use permits a taxpayer to relinquish certain investment property and replace it with other like-kind investment property without triggering capital gains liability. Thus the owner has additional capital available for the purchase of the replacement property, which otherwise would have been paid in taxes. Payment of the tax on the gain is deferred until the final replacement property is sold.

Like Kind Exchanges, also known as tax deferred exchanges, are defined by Internal Revenue Code (IRC) section 1031. A 1031 Tax Deferred Exchange offers taxpayers on of the last great opportunities to build wealth and save taxes. By completing a 1031 Exchange, the Taxpayer (“Exchanger”) can dispose of investment or business-use assets, acquire replacement property and defer the tax that would ordinarily be due upon the sale.

Non-U.S. Citizen Seller

If you are selling property and are not a U.S. citizen, we will coordinate efforts with you and the proper FIRPTA associates to make sure the paperwork is done properly. There are special Department of Treasury requirements that a foreign seller must follow and we want to make sure you sale follows these instructions.
